{"id":94629,"date":"2025-02-27T10:47:02","date_gmt":"2025-02-27T13:47:02","guid":{"rendered":"https:\/\/gysfm.com.ar\/inicio\/la-experiencia-me-indica-que-no-es-correcto\/"},"modified":"2025-02-27T10:47:04","modified_gmt":"2025-02-27T13:47:04","slug":"la-experiencia-me-indica-que-no-es-correcto","status":"publish","type":"post","link":"https:\/\/gysfm.com.ar\/inicio\/la-experiencia-me-indica-que-no-es-correcto\/","title":{"rendered":"La experiencia me indica que no es correcto"},"content":{"rendered":"<p><\/p>\n<div>\n<p>Primero reuni\u00f3 a su partido, despu\u00e9s dej\u00f3 trascender la postura mayoritaria y finalmente, en la \u00faltima hora de este mi\u00e9rcoles, <strong>Mauricio Macri <\/strong>decidi\u00f3 expresar \u00e9l mismo su cr\u00edtica a la designaci\u00f3n de los<strong> jueces Ariel Lijo y Manuel Garc\u00eda-Mansilla<\/strong> en la Corte Suprema, mediante un decreto y en comisi\u00f3n, como decidi\u00f3 el Presidente.<\/p>\n<\/div>\n<div>\n<p>El expresidente lo hizo con una autocr\u00edtica. \u00abLa experiencia emp\u00edrica me indica que la <strong>designaci\u00f3n de jueces<\/strong> a trav\u00e9s de un mecanismo como el utilizado por el gobierno <strong>no es correcta<\/strong>\u00ab, escribi\u00f3 en su cuenta de X. No necesit\u00f3 aclarar que se refer\u00eda a su propia marcha atr\u00e1s cuando intent\u00f3 designar a Horacio Rosatti y Carlos Rosenkrantz -hoy jueces del m\u00e1ximo tribunal- por la misma v\u00eda que Javier Milei.<\/p>\n<\/div>\n<div>\n<p>Luego avanz\u00f3 con su postura personal y con su rechazo, en especial, a la incorporaci\u00f3n de Ariel Lijo. \u00abRatifico mi posici\u00f3n de que los jueces que ocupen los cargos m\u00e1s altos del Poder Judicial no pueden ser objeto de tanto rechazo\u00bb. <\/p>\n<\/div>\n<div>\n<p>\u00abLa confianza en la justicia y en las instituciones es una condici\u00f3n indispensable para la estabilidad de la democracia y la prosperidad del pa\u00eds. Mi posici\u00f3n es la mayoritaria dentro del PRO, como qued\u00f3 plasmada en el informe producido por la Fundaci\u00f3n Pensar\u00bb, especific\u00f3 Macri.<\/p>\n<\/div>\n<div>\n<p>En su posteo tard\u00edo, el fundador del PRO sum\u00f3 una publicaci\u00f3n del think tank macrista, cr\u00edtico del proceso de designaci\u00f3n y de los candidatos elegidos por la administraci\u00f3n libertaria. Es un art\u00edculo de<strong> Mart\u00edn Casares<\/strong>, secretario general del Colegio P\u00fablico de la Abogac\u00eda de la Capital Federal y consultor de Pensar, que en su descargo indic\u00f3: \u00abDado el rol de lo magistrados y su obligaci\u00f3n de decidir con imparcialidad, es esencial garantizar su independencia judicial mediante la estabilidad en el cargo\u00bb.<\/p>\n<\/div>\n<div>\n<p>En ese marco, el letrado plante\u00f3: \u00abLa designaci\u00f3n en comisi\u00f3n por parte del Poder Ejecutivo <strong>compromete a esta independencia<\/strong>, ya que los jueces interinos dependen de la aprobaci\u00f3n posterior del Ejecutivo y el Senado, lo que afecta su capacidad para dictar sentencias con plena independencia y <strong>erosiona el principio de divisi\u00f3n de poderes<\/strong>\u00ab.<\/p>\n<\/div>\n<div>\n<p>Casares tambi\u00e9n afirm\u00f3 que \u201cla designaci\u00f3n de jueces por decreto impacta negativamente en la seguridad jur\u00eddica y la confianza p\u00fablica\u201d.<\/p>\n<\/div>\n<div>\n<p>\u201cEsta soluci\u00f3n constitucionalmente permitida no es deseable; y en mi opini\u00f3n traer\u00eda aparejadas consecuencias negativas para el Gobierno y la Justicia\u201d, a\u00f1adi\u00f3 el abogado, quien sostuvo que la medida del oficialismo \u00ab<strong>va a afectar la credibilidad de la Corte Suprema\u00bb.<\/strong><\/p>\n<\/div>\n<div>\n<p>Macri, quien apunt\u00f3 fuerte contra la postulaci\u00f3n de Lijo desde el comienzo, junt\u00f3 a los principales dirigentes del PRO, entre los que estuvieron Jorge Macri (Ciudad Aut\u00f3noma de Buenos Aires), los intendentes Soledad Mart\u00ednez (Vicente L\u00f3pez) y Guillermo Montenegro (Mar del Plata), los diputados nacionales Cristian Ritondo, Mar\u00eda Eugenia Vidal y Diego Santilli; el senador nacional Alfredo De Angelis (de Entre R\u00edos); Facundo P\u00e9rez Carletti, secretario general del partido, y Fernando De Andreis, hombre de m\u00e1xima confianza de Macri. <\/p>\n<\/div>\n<div>\n<p>No estuvo presente en la cumbre el entrerriano Rogelio Frigerio y s\u00ed particip\u00f3, pero a trav\u00e9s de Zoom, el chubutense Ignacio Torres.<\/p>\n<\/div>\n<div>\n<p>Seg\u00fan averigu\u00f3 <strong><em>Clar\u00edn<\/em><\/strong>, desde el espacio opositor se baraj\u00f3 la posibilidad de publicar un comunicado contra los nombramientos por decreto.
